Neither Indigenous data nor intellectual property were signed away in treaty, which raises interesting implications for the modern era. In a time of reconciliation, how do we affirm Indigenous rights and sovereignty in digital and online spaces? What processes exist (or should exist) to protect Indigenous data and intellectual property? In this presentation, Kyle Napier will review the issues and rights within legal frameworks across Canada that relate to the protection of Indigenous IP and personal data. He will also look at perspectives and actions being taken by Indigenous communities and governments around the world, in a presentation touching on sui generis copyright and trade secret laws, digital efforts towards language and cultural reclamation, and suggestions for affirming intellectual property and data rights of Indigenous Peoples.
